Terms of Service

These Terms of Service (“Terms”) govern access to and use of Zwifhatwa Properties (“Zwifhatwa”, “we”, “us”) — including our website, mobile applications, APIs, and resident desk experiences. By creating an account or using the service, you agree to these Terms.
1. The service
Zwifhatwa provides software for property and facilities teams to manage buildings, maintenance workflows, members, billing, notifications, and related operations. Features may change over time as we improve the product.
2. Accounts and eligibility
- You must provide accurate company and account information when signing up.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Company administrators control invitations, roles, and access within their workspace.
- You must be legally able to enter into a binding agreement to use Zwifhatwa.
3. Acceptable use
You agree not to:
- Use the service for unlawful, harmful, or fraudulent purposes.
- Upload content that infringes third-party rights or contains malware.
- Attempt to bypass security, access another user’s data without authorisation, or disrupt the platform.
- Reverse engineer or resell the service except as expressly permitted by us.
4. Customer content
You retain ownership of data, files, and content you upload to Zwifhatwa. You grant us a limited licence to host, process, display, and transmit that content solely to provide and improve the service — including applying your company branding on tenant-facing touchpoints where configured.
You are responsible for ensuring you have the right to upload and process personal information about your tenants, staff, and members, and for providing any required notices to them.
5. Subscriptions, trials, and billing
- Paid plans, free trials, building slot limits, and member limits are described on our billing pages.
- Payments are processed by Paystack. By subscribing, you authorise recurring charges according to your selected plan until you cancel.
- Cancellations take effect at the end of the current billing period unless stated otherwise.
- Fees are non-refundable except where required by applicable law.
6. White-label branding
Branding features (such as logo, display name, and reply-to email) are included according to your plan. Higher-tier plans may allow removal of the “Powered by Zwifhatwa” footer on tenant touchpoints. You must not use branding features to impersonate another organisation or mislead tenants.
7. Availability and support
We aim to keep Zwifhatwa available and secure, but the service is provided on an “as is” and “as available” basis. Scheduled maintenance, third-party outages, or events outside our reasonable control may cause interruptions. Support is available at support@zwifhatwa.com.
8. Intellectual property
Zwifhatwa, including its software, design, and branding (excluding your content), is owned by us or our licensors. These Terms do not grant you ownership of our platform or trademarks.
9. Termination
You may stop using Zwifhatwa at any time. We may suspend or terminate access if you breach these Terms, fail to pay applicable fees, or if required by law. Upon termination, your right to access the service ends, subject to any data export or retention obligations described in our Privacy Policy.
10. Disclaimer and limitation of liability
To the maximum extent permitted by law, Zwifhatwa is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim, or ZAR 1,000 if you have not paid fees, whichever is greater.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your use of the service, your content, or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes will be subject to the exclusive jurisdiction of the courts of South Africa, unless mandatory law provides otherwise.
13. Changes
We may update these Terms from time to time. Continued use after the updated Terms are posted constitutes acceptance of the changes. If you do not agree, you must stop using the service.
